Cellars Market Pty Ltd the company owning CellarsMarket is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

Contracts Policy

As CellarsMarket operates as a pure-play marketplace platform, it does not sells its own goods. CellarsMarket is a marketplace platform whereby it allows independent third-party Sellers who abide by our policies and the Sellers Participation Agreement to sell goods on our Website.

When you purchase any good, you are entering into an agreement with the Seller. The listing of the good will contain the Seller's details in addition to any terms of sale specific to the Sellers goods (such as delivery timetables).

By purchasing any good, you are entering into a contract directly with the Seller, and CellarsMarket is not a party to the contract. The Seller has the ultimate right to decide if the order can or will be fulfilled. Legitimate data errors can occur from time to time such as inaccurate inventory levels and pricing.

Since CellarsMarket is not a party to these contracts between buyers and Sellers, we do not review contracts, adjudicate or take sides in any contract disputes. CellarsMarket also does not search for items that may raise these types of issues or enforce terms from third parties restricting the resale of an item.

You agree that as a platform for independent Sellers, CellarsMarket is not responsible for the transactions that occur between you (customer) and the Seller, nor are we responsible for the Seller's goods or services to the extent permitted by law.

CellarsMarket does not make any warranty or representation regarding the standard of any goods or services to be supplied by the Seller. Nothing identified here is to have the effect of restricting or modifying any rights or obligations that cannot be restricted or modified by law (including the Australian Consumer Law).

 

Age Restricted Items

Alcohol products available on Cellars Market are age-restricted. By placing an order for alcohol you are declaring that you are 18 years of age or over.

We take our responsibility in relation to the sale of age-restricted items extremely seriously. Valid photographic ID and a signature of the recipient may be required upon delivery for customers. If your order is being delivered to a commercial address or residential apartment block, the receptionist, concierge or mail room attendant receiving your package may need to provide a valid photo ID, showing that they are aged 18 or over. If the recipient is not over the age of 18 and has not been able to show valid photo identification, the item will be returned to a nearby post office for collection or returned to the vendor

You can also nominate a post office box (PO box) address for delivery of these items. Deliveries to a PO box will be left with a card for collection from the local post office.

Liquor License Information

This Site is intended to be used and accessed by people who are of legal age to purchase and consume alcohol.

No Alcohol can be sold or supplied to anyone under 18. It's against the law.

IT IS AGAINST THE LAW TO SELL OR SUPPLY ALCOHOL TO, OR TO OBTAIN ALCOHOL ON BEHALF OF, A PERSON UNDER THE AGE OF 18 YEARS. Vendors who sell to a person under the age of 18 years will be removed and banned from transacting on Cellars Market and reported to the liquor licensing body of their State which may lead to a loss of their license.

Product Information and Images

Information about goods (including but not limited to pricing and stock levels) on the Website is based on material provided by third-party Sellers, a data-automation syncing feature, suppliers and/or product manufacturers. At times, there may be an error in this information and except as required by law (including the Australian Consumer Law) we cannot be held responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties.


You agree to make your own enquiries with the individual Seller to verify information provided and to assess the suitability of goods or services before you order the goods or services.Due to limitations in photographs and screen depictions of images, the representation of goods may slightly differ between the way they appear on the Website and when received.

Additionally, at times depictions of goods or services are created or chosen by us for promotional purposes, and may not be a precise and exact representation of the goods or service received.

What is Personal Information and why do we collect it?

We do not guarantee website links or the policy of authorised third parties.

Google reCAPTCHA is implemented on our platform and is used to fight spam and abuse on our site. reCAPTCHA is subject to the Google Privacy Policy and Terms of Use.

Cellars Market will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.
